Terms of Service

By uploading a file or making a payment, you agree to these Terms. If you do not agree, do not use the Service.
1. What We Do
DBRescue is an automated data extraction service operated by CS IT-Services GbR. We:
- Accept uploads of legacy database files (Microsoft Access .mdb/.accdb, dBASE .dbf, and similar formats)
- Extract the data from these files using automated processing
- Provide the extracted data in modern formats (CSV and/or JSON)
- Make the output available for download for 24 hours
This is an automated, self-service tool. We do not manually review your files or provide consulting services through this platform.
2. What We Do NOT Do
- Verify or guarantee the accuracy of your source data
- Clean, transform, or enhance your data beyond extraction
- Provide assistance importing data into other systems
- Recover severely corrupted or password-protected files
- Store your data beyond the 24-hour download period
3. Your Responsibilities
3.1 Rights to Data
You represent and warrant that:
- You own or have legal rights to the files you upload
- You have authority to extract and download the data
- Your use does not violate any third-party rights or applicable laws
3.2 Acceptable Use
You agree NOT to:
- Upload files containing malware, viruses, or malicious code
- Upload files containing illegal content
- Attempt to reverse-engineer, exploit, or abuse the Service
- Circumvent any rate limits or usage restrictions
4. Payment Terms
4.1 Pricing
- Files under 50 MB: Free
- Files 50 MB and above: $9.99 per file (USD)
4.2 Payment Processing
All payments are processed by Stripe, Inc. We do not store your credit card information.
4.3 Refund Policy
Automatic Refund: If our system cannot extract data from your file (due to unsupported format, severe corruption, or technical failure), you will receive an automatic full refund.
No Refund After Download: Once you successfully download your extracted data, no refunds are available.
Contact: support@cs-itservices.de with your transaction ID for refund inquiries.
5. Data Handling
- Source files: Deleted within 24 hours of processing
- Output files: Available for 24 hours, then permanently deleted
- No backups: We do not retain copies after deletion

6. Service Availability
This is a self-service platform provided "as-is." We do not guarantee continuous, uninterrupted availability or specific processing times.
7. Disclaimers and Limitations
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF EXTRACTED DATA.
Data Accuracy: We extract data as it exists in your source files. We do NOT verify accuracy or guarantee 100% recovery from corrupted files.
Limitation of Liability: Our total liability is limited to the amount you paid for the specific transaction. We are NOT liable for indirect, incidental, or consequential damages.
8. Intellectual Property
Your Data: You retain all rights to your data. We claim no ownership interest.
Our Service: All aspects of the Service are owned by CS IT-Services GbR.
9. Governing Law
For consumers in the European Union: German law applies. You may bring disputes in German courts or the courts of your home jurisdiction. Mandatory consumer protection laws of your country of residence apply.
For all other users: These Terms are governed by the laws of the State of Delaware, USA.

10. Changes to Terms
We may update these Terms. Changes take effect when posted. Continued use constitutes acceptance.
